This 1 day seminar will introduce participants to Ontario’s compensation legislation, principles and third party rights. Participants will explore key definitions like disablement, recurrence, aggravation, occupational disease and stress. They will discuss reporting of injuries, filing of claims, process of appeal and responsibilities of workplace parties and medical professionals. As well, participants will examine WSIB policies regarding layoffs and plant closings and their impact on worker’s claims and entitlements.

This 1 day seminar will examine the rules and use of electronic evidence to advance a worker’s compensation claim and pitfalls in using this type of evidence. Also, participants will examine the history of mental stress claims including sections of the WSIA that prohibit payment of stress claims. The WSIB policies related to mental stress will also be discussed along with key WSIAT decisions. Policy considerations regarding occupations with cumulative exposures will also be discussed. The Professional Responsibilities seminar examines the Access to Justice Act and provisions regulating paralegals and code of conduct. It reviews responsibilities that include advocacy, confidentiality, professionalism, administration of justice and competency.
